"Jury Rules Prempro Caused Breast Cancer In HRT Trial"
Oct 5 , 2006
A women and her husband were awarded $1.5 million compensation in the first phase of a hormone replacement therapy trial after a Philadelphia jury found that Prempro at least partially resulted in the women developing breast cancer.
Jennie Nelson, 66, took Wyeth’s Prempro for five years to relieve symptoms of menopause. In 2001, she was diagnosed with breast cancer and underwent a double mastectomy, radiation therapy, and chemotherapy.
After hearing several weeks worth of testimony in the second federal Prempro trial, the jury ruled that the hormone therapy drug caused Nelson’s breast cancer and awarded her $1 million and her husband $500,000 in compensation.
“The medical evidence overwhelmingly showed that Wyeth’s drug Prempro caused her breast cancer,” said Nelson’s lawyer Tobi Millrood.
The trial will move into the second phase in October to determine if Wyeth failed to sufficiently warn doctors and patients of the dangerous side effects of Prempro. If the jury finds the drug company was negligent, they may add punitive damages to the award amount. If Wyeth is not guilty of negligence, no compensation will be payable.
Currently, more than 5,000 defective drug lawsuits have been filed in the U.S. against Wyeth. Two have gone to trial.
HRT drugs have also been linked to other serious side effects including heart attack, blood clots, stroke, ovarian cancer, hearing loss, and dementia.
